AG Advises the Copyright Office on Deposit Requirement for Ebooks

The Authors Guild also submitted comments in response to the Copyright Office’s inquiry about a rule requiring deposits of electronic books for the Library of Congress’s collections. The Guild had previously made recommendations to tailor the rule, many of which were accepted, including one that would remove the requirement that deposit copies be free of any technological protections. The rule will allow the Library of Congress to begin collecting deposit copies of books published only in electronic formats. Unlike the mandatory deposit requirements for physical deposit copies, the proposed ebook rule is “demand-based”—meaning that publishers of ebooks will not have to automatically deposit ebooks, but only if the Office makes a demand. You can read the Guild’s comments below.
